Terms of Use

These terms are an agreement between you and Dylan C. Herlehy (“we”, “us”), who operates the Fasting with Purpose companion app at fastingwithpurpose.com (the “app”). By creating an account or using the app, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the app.

1. Who can use it

You must be at least 18 years old. By using the app you confirm that you are, and that you can form a binding agreement.

2. Not medical advice

The program involves extended daily fasting, cold exposure, and intense training. The app and its content are for general education and motivation. They are not medical advice and do not replace a doctor.

Talk to a qualified health professional before you begin, and do not start this program without one's approval if you are pregnant or nursing; have diabetes, a heart condition, low blood pressure, or another medical condition; have a history of disordered eating; or take any medication. Stop and get medical help if you feel faint, dizzy, confused, or unwell. Reminders and targets in the app are prompts, not instructions to push through warning signs.

3. Your responsibility

You choose whether and how to follow the program, and you are responsible for listening to your body. To the fullest extent the law allows, you take on the risks of fasting, cold exposure, and exercise that you choose to do.

4. Your account

You sign in with a one-time link sent to your email, so anyone with access to your inbox can reach your account. Keep your email secure. One account per person. Tell us at hello@fastingwithpurpose.com if you think someone else has used your account.

5. Your data

What you enter (logs, measurements, reflections) stays yours. You give us permission to store and process it only to run the app for you, as described in the Privacy Policy. You can ask us to delete it at any time.

6. Our content

The program, the laws, the phase plans, and the app's text and design are owned by Dylan C. Herlehy and protected by copyright. You may use them for your own personal, non-commercial practice. Don't copy, resell, or republish them.

7. Acceptable use

Don't misuse the app: no trying to access other people's accounts or data, interfering with the service, scraping it, or using it to break the law.

8. Emails

We send sign-in links when you request them and, unless you turn them off, reminder emails. You can turn reminders off at any time in the app or from any reminder.

9. Changes and ending the service

We may change or pause features, and we may suspend accounts that break these terms. You can stop using the app at any time and ask us to delete your account. If we ever shut the app down, we'll give you notice and a way to get a copy of your data first.

10. Other services

The app links to Amazon for the book and relies on third-party providers to run. We aren't responsible for other companies' sites or services.

11. Disclaimers

The app is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose. We don't promise any particular result from the program, or that the app will always be available or free of errors.

12. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any injury or health outcome from following the program. Our total liability for any claim about the app is limited to one hundred US dollars (US$100). Some places don't allow these limits, so they may not all apply to you.

13. Indemnity

If you break these terms or the law while using the app, and that causes a claim against us, you agree to cover the reasonable costs of that claim.

14. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, unless the law where you live gives you the right to bring it elsewhere.

15. Changes to these terms

If we change these terms, we'll update the date at the top. If a change is material, we'll email you before it takes effect. Continuing to use the app after that means you accept the new terms.
